2. Hizmetin Temel Nitelikleri ve Fiyat

  • Hizmet Tanımı: Formuloto.com platformu üzerinden sunulan, istatistiksel verilere dayalı kombinasyon formülasyonu ve analiz sağlayan SaaS (Yazılım) hizmetidir.
  • Paket Seçimi: Alıcı; Silver (1 Ay), Gold (6 Ay) veya Diamond (12 Ay) paketlerinden birini seçerek işbu formu onaylamaktadır. Paketlerin kayıtlı kombinasyon oluşturma limitleri ve arşiv erişim süreleri "Fiyat Listesi" sayfasında belirtildiği gibidir.
  • Fiyat: Sipariş anında ekranda belirtilen ve Alıcı tarafından onaylanan toplam tutardır. Belirtilen fiyatlar ve vaatler sipariş anında geçerlidir. Bir sonraki yenileme döneminde Satıcı fiyat güncelleme hakkını saklı tutar. Alıcı, siparişi onaylayarak bu Ön Bilgilendirme Formu'nda yer alan temel nitelikler, fiyat ve iade koşulları hakkında tam bilgi sahibi olduğunu kabul ve beyan eder.

3. Ödeme ve İfa (Teslimat)

  • Ödeme Yöntemi: Ödemeler Stripe güvenli ödeme altyapısı üzerinden kredi kartı/banka kartı ile tahsil edilir.
  • İfa Süreci: Ödeme onayı alındığı anda hizmet Alıcı'nın kullanımına açılır. Herhangi bir fiziksel teslimat söz konusu değildir.
  • Otomatik Yenileme: Alıcı tarafından iptal edilmediği sürece abonelik, paket süresi sonunda otomatik olarak yenilenir.

4. Cayma Hakkı ve İade (Kritik Uyarı)

  • Cayma Hakkı İstisnası: İşbu hizmet, "elektronik ortamda anında ifa edilen gayrimaddi hizmetler" kapsamında olduğundan, Kullanıcı (Alıcı), ödeme işlemini tamamladığı an hizmetin ifasına başlanacağını ve bu aşamadan sonra 6502 sayılı Tüketicinin Korunması Hakkında Kanun ve ABD Uniform Commercial Code (UCC) ile uluslararası dijital ticaret hukukuna uygun olarak "anında ifa edilen hizmetler" kapsamında cayma hakkının bulunmadığını açıkça kesin olarak kabul, beyan ve taahhüt eder.
  • İade Politikası: Ödeme yapıldığı ve hizmet erişime açıldığı andan itibaren, yanlış paket seçimi veya kullanım vazgeçişi dahil olmak üzere hiçbir koşulda ücret iadesi yapılmaz.

5. Şikayet ve Uyuşmazlık Çözümü

  • Alıcı, hizmete ilişkin her türlü şikayetini legal@formuloto.com adresi üzerinden Satıcı'ya iletebilir.
  • İşbu formdan ve sonrasında imzalanacak Mesafeli Satış Sözleşmesi'nden doğabilecek tüm ihtilaflarda North Dakota (USA) yasaları uygulanır. Uyuşmazlıklar, mahkeme öncesinde North Dakota yasalarına uygun tahkim yolları kuralları çerçevesinde tahkim yoluyla çözülecektir. Alıcı, toplu dava açma hakkından feragat ettiğini peşinen kabul eder. Satıcı'nın olası bir uyuşmazlıktaki toplam mali sorumluluğu, Alıcı'nın son 12 ayda platforma ödediği toplam tutarı hiçbir koşulda geçemez.

6. Yürürlük

Alıcı, bu formu elektronik ortamda onaylayarak, Mesafeli Satış Sözleşmesi'ni akdetmeden önce tüm temel nitelikler, fiyat, ödeme ve iade şartları konusunda bilgilendirildiğini kabul eder.

Pre-Information Form

1. Seller Information

2. Basic Features and Price of the Service

  • Service Description: A SaaS (Software) service provided via the Formuloto.com platform that offers combination formulation and analysis based on statistical data.
  • Plan Selection: The Buyer approves this form by selecting one of the Silver (1 Month), Gold (6 Months), or Diamond (12 Months) plans. The registered formula combination generation limits and archive access durations for the plans are as specified on the "Price List" page.
  • Price: The total amount displayed on the screen at the time of the order and approved by the Buyer. The stated prices and commitments are valid at the time of the order. The Seller reserves the right to update prices for the next renewal period. By approving the order, the Buyer acknowledges and declares that they have full information regarding the basic features, price, and refund terms set forth in this Pre-Information Form.

3. Payment and Performance (Delivery)

  • Payment Method: Payments are collected via credit card/debit card through the Stripe secure payment infrastructure.
  • Performance Process: The service is activated for the Buyer's use the moment the payment confirmation is received. Since the service is a digital software service (SaaS) performed immediately in an electronic environment, no physical delivery is required.

4. Right of Withdrawal and Refund (Critical Notice)

  • Exception to the Right of Withdrawal: As this service falls under the category of "intangible services performed immediately in an electronic environment," the User (Buyer) explicitly and definitively accepts, declares, and undertakes that the performance of the service begins the moment the payment transaction is completed. Consequently, there is no right of withdrawal within the scope of "immediately performed services" in accordance with Law No. 6502 on the Protection of Consumers, the US Uniform Commercial Code (UCC), and international digital trade laws.
  • Refund Policy: Once the payment is made and access to the service is granted, no refunds will be issued under any circumstances, including incorrect plan selection or deciding to stop using the service.

5. Complaints and Dispute Resolution

  • The Buyer may submit any complaints regarding the service to the Seller via the legal@formuloto.com address.
  • In all disputes arising from this form and the Distance Sales Agreement to be signed subsequently, the laws of North Dakota (USA) shall apply. Disputes shall be resolved through arbitration in accordance with North Dakota arbitration rules before going to court. The Buyer acknowledges in advance that they waive the right to participate in a class action. The Seller's total financial liability in any potential dispute shall under no circumstances exceed the total amount paid by the Buyer to the platform in the last 12 months.
